On or about February 4, 2014, the Sacramento District Attorney's Office filed a criminal complaint charging one count of violation of PC 25850(a) misdemeanor carrying a loaded firearm and one count of PC 25400(a)(2) misdemeanor carrying a loaded weapon. On or about February 26, 2014, the matter was disposed with a guilty plea to the count of violation of PC 25400(a) misdemeanor carrying a concealed weapon. Pursuant to the plea agreement, the court dismissed the remaining count in the furtherance of justice. This is a proceeding pursuant to sections 6101 and 6102 of the Business and Professions Code and rule 9.10 of the California Rules of Court.

The court orders that Damon Eric Gardner, State Bar Number 226776, is suspended from the practice of law for two years, execution of that period of suspension is stayed, and he is placed on probation for two years subject to the following conditions: 1. Damon Eric Gardner is suspended from the practice of law for the first 90 days of probation; 2. Damon Eric Gardner must comply with the other conditions of probation recommended by the Hearing Department of the State Bar Court in its Order Approving Stipulation filed on September 11, 2015; and 3. At the expiration of the period of probation, if Damon Eric Gardner has complied with all conditions of probation, the period of stayed suspension will be satisfied and that suspension will be terminated. Pass the Multistate Professional Responsibility Exam within one year of the effective date of the Order. Comply with California Court Rules of Court, rule 9.20, and perform the acts specified in subdivisions (a) and (c) of that rule within 30 and 40 calendar days, respectively, after the effective date of the Order. Costs awarded to the State Bar.
