ON MAY 1, 2000, I WAS DRIVING FROM SAN DIEGO TO SAN FRANCISCO ON HIGHWAY 5. AT AROUND 1AM I WAS TIRED AND SLEEPY SO I TURNED UP THE VOLUME ON MY RADIO TO THE LOUDEST SETTING TO KEEP MYSELF FROM FALLING ASLEEP.I WAS DRIVING PRETTY FAST, HOPING TO GET TO SAN FRANCISCO FASTER. I WAS STOPPED BY THE POLICE ON HIGHWAY 5 NEAR A SMALL TOWN OF PATTERSON, CALIFORNIA FOR DRIVING TOO FAST. THE POLICE TOLD ME THAT HE HAD BEEN PURSUING ME FOR QUITE SOME TIME. SO HE WAS UNDER THE IMPRESSION THAT I WAS TRYING TO GET AWAY. IN REALITY, I DID NOT EVEN HEAR THE SIREN BECAUSE MY RADIO WAS TURNED UP TOO HIGH. AFTER SOME TIME, I FINALLY REALIZED THAT THE POLICE WAS DRIVING BEHIND ME AND SO I PULLED OVER.
HE WENT THROUGH MY TRUNK TO DO A SEARCH BECAUSE HE THOUGHT I WAS HIDING SOMETHING. HE DID NOT FIND ANYTHING. HE THEN CHARGED ME WITH:

FELONY RECKLESS EVADING
DURING THAT TIME, I WAS A COLLEGE STUDENT (ATTENDING UCSD) AND HAD NO MONEY TO PAY FOR AN ATTORNEY. I NEEDED TO RESOLVE THE MATTER QUICKLY SO THAT I COULD GO BACK TO SCHOOL. IN ORDER TO DO SO, MY PUBLIC DEFENDER RECOMMENDED THAT I PLEAD TO THE LESSER CHARGE OF A MISDEMEANOR OF RECKLESS DRIVING.
