Former client alleges that she informed FA she intended to use a specified amount of funds from her investment account in the short term to buy a home but that FA improperly invested those funds in stocks and US Treasury bonds resulting in a loss.

Customer's accounts were managed by a different Financial Advisor (FA) of the firm-not me-to whom the customer expressly provided discretionary trading authority, allowing him to manage her accounts on a discretionary basis following her general investment strategy. In my limited role in the customer's relationship with the firm, I did not and could not manage or trade in her accounts. As to my limited role, I always did my best to diligently and thoughtfully communicate with the customer, to fully understand her financial situation, objectives, and directions, to accurately communicate them to her FA, and to otherwise facilitate the exchange of accurate information and clear communication between the customer and her FA. The firm's review of this matter did not find wrongdoing. Without the customer having filed any proceeding or action and believing any such filing would lack merit, I made the pragmatic decision to nonetheless pay a small "nuisance-value" amount in settlement to avoid the cost and distraction of litigation.
