Pursuant to FINRA Rule 9552(h) and in accordance with FINRA's Notice of Suspension and Suspension from Association letters dated February 3, 2017 and February 27, 2017, respectively, on May 8, 2017, Mallett is barred from association with any FINRA member in any capacity. Respondent failed to request termination of his suspension within three months of the date of the Notice of Suspension; therefore, he is automatically barred from association with any FINRA member in any capacity.
On June 5, 2017, David Mallett filed with the SEC an application for review of the bar letter dated May 8, 2017. The bar is in effect.
SEC Admin Release 34-81355 / August 8, 2017:
On June 21, 2017, FINRA filed a motion to dismiss Mallett's appeal.
On July 11, 2017, the Office of the Secretary received from Mallett a notice regarding his appeal. The notice explained that "[u]pon further consideration, Mallett hereby withdraws his application for review."
It is ordered that the request by David Mallett to withdraw his application for review be, and it hereby is, granted and that this review proceeding be, and hereby is, dismissed.
