Lewis was named a respondent in a FINRA complaint alleging that she willfully failed to timely amend her Form U4 to disclose a reportable event. The complaint alleges that Lewis knowingly provided false attestations on her member firm's annual compliance questionnaire by denying a reportable event. Lewis also knowingly provided false information to FINRA on a FINRA, examination-related, personal activity questionnaire (PAQ) by denying a reportable event.

The Decision includes a finding that Lewis willfully failed to disclose a material fact on a Form U4, and that under section 3(a)(39)(f) of the Securities Exchange Act of 1934 and Article III, Section 4 of the FINRA By-Laws, this omission make her subject to a statutory disqualification with respect to association with a member.
Regulator Statement
Hearing Panel Decision rendered July 16, 2018, wherein Lewis was barred from association with any FINRA member in all capacities, and ordered to pay $6,247.25 in costs. The sanctions were based on findings that Lewis willfully failed to timely amend her Form U4 to disclose a reportable event. The findings stated that the information Lewis failed to disclose was material. The information Lewis failed to update was material that subjects her automatically to a statutory disqualification from the securities industry. In addition, Lewis knowingly provided false information to FINRA on a FINRA questionnaire by denying a reportable event and it was unethically and in bad faith. Further, Lewis knowingly provided false information on her member firm's compliance questionnaire relating to the material fact.
Because Lewis acted willfully in failing to amend her Form U4 with material information that was required to be disclosed on the Form U4, she will be subject to statutory disqualification.
On August 7, 2018, respondent Kris Lewis filed with the Office of Hearing Officers a notice of appeal of the Hearing Panel decision dated July 16, 2018. The sanctions are not in effect pending review.
On April 2, 2019, FINRA acknowledged receipt of Lewis' Notice of Withdraw of her appeal dated February 22, 2019. Accordingly, the matter is now final.
