INVESTMENT ADVISOR CREATED A PORTFOLIO OF DIVERSIFIED MUTUAL FUNDS, REPRESENTING MULTIPLE ASSET CLASSES, FOR CLIENTS IN JANUARY 2007. ADVISOR MANAGED THIS PORTFOLIO FOR CLIENTS TO DECEMBER 2008, WHEN CLIENTS REQUESTED THAT MUTUAL FUND PORTFOLIO BE LIQUIDATED, TO CASH.
IN JANUARY 2011, ADVISOR RECEIVED DEMAND FOR ARBITRATION FILING BY CLIENTS. THE FILING INCLUDED ALLEGATIONS THAT: SPECIFIC MUTUAL FUND RECOMMENDATIONS WERE NOT ALIGNED WITH CLIENTS' INVESTMENT NEEDS, OBJECTIVES AND RISK TOLERANCE; CLIENTS' INVESTMENT PORTFOLIO WAS NOT PROPERLY MANAGED AND MONITORED; AND, THE LIQUIDATION WAS NOT FULLY AUTHORIZED. ADVISOR DOES NOT AGREE WITH ANY OF THE ALLEGATIONS, AND ADVISOR'S COUNSEL HAS STATED SUCH IN THE WRITTEN RESPONSE TO THIS ARBITRATION FILING.
