3/09-4-30/09; THE CLIENT FEELS THAT BECAUSE THE FA TOLD HIM IF HE GOT OUT OF HIS MUTUAL FUNDS HE COULD GET BACK IN AT ANY TIME THAT THIS CONVINCED HIM TO GO BACK INTO CASH. THE CLIENT STATES THAT THE FA LEARNED THERE WAS A 30 WAITING DAY PERIOD AT A LATER DATE. THE CLIENT STATES HE DID CONTACT THE FA THE DAY AFTER HE GOT OUT OF THE MARKET ABOUT GETTING BACK IN AND STATES THE FA SUGGESTED TO WAIT. THE CLIENT STATES HE MET WITH THE FA THE FOLLOWING FRIDAY AND THE FA TOLD HIM HE COULD NOT GET BACK IN TO THE SAME FUNDS BECAUSE OF THE 30 DAY WAITING PERIOD. THE CLIENT STATES THE FA SUGGESTED HE WAIT UNTIL THE FOLLOWING WEDNESDAY TO DISCUSS WITH HIS SON. THE MARKET WENT UP AND LEFT HIM IN A BAD POSITION. THE CLIENT STATES THAT THE FA IS AN HONEST PERSON AND TRIED TO DO THE RIGHT THING, BUT FEELS THAT BY GIVING HIM WRONG INFORMATION WHEN HE MOVED HIS FUNDS BACK INTO CASH AND SUGGESTING THAT HE WAIT TO GET BACK IN THE MARKET HAS CAUSED HIS LOSSES. POTENTIAL LOSSES EXCEED $5,000.

THE CLIENT TALKED WITH THE FA ABOUT GETTING THE MONEY INVESTED INTO MUTUAL FUNDS OUT OF THE MARKET AND INTO MONEY MARKET AS HE WAS CONCERNED ABOUT THE DECLINE OF THE VALUE OF THE FUNDS. THE CLIENT HAD INDICATED THAT HE EVENTUALLY PLANNED TO RETURN TO THE MARKET AND WOULD CONTACT THE FA WHEN THE TIME HAD COME. THE FA AND CLIENT HAD SEVERAL CONVERSATIONS WITHIN THE FOLLOWING FEW WEEKS REGARDING HIS UNEASY FEELINGS ABOUT THE MARKET AND HIS DECISIONS TO GET OUT. THE FA OFFERED ON SEVERAL OCCASIONS TO INVEST BACK INTO THE MARKET, HOWEVER, THE CLIENT DECLINED AND INSTRUCTED THE FA TO LEAVE THE FUNDS WHERE THEY WERE UNTIL HE DECIDED OTHERWISE. THE FA DID TELL THE CLIENT ABOUT THE WAITING PERIOD THAT APPLIED ONLY TO THE AMERICAN FUNDS. HOWEVER, IT DOES NOT APPEAR AS THOUGH HIS DECISION TO GET OUT OF THE MARKET OR WHEN TO GET BACK IN THE MARKET WAS IMPACTED EITHER WAY BY THIS INFORMATION.
