Without admitting or denying the findings, McCormick consented to the sanctions and to the entry of findings that he refused to appear for testimony at FINRA staff's request. The findings stated that FINRA staff initiated an investigation into the circumstances surrounding McCormick's termination from his member firm and customer complaints against McCormick that the firm had reported to FINRA on McCormick's Form U5. The staff issued a letter requesting McCormick's appearance at FINRA's offices to testify under oath, but as stated in his email to the staff and by this agreement, McCormick acknowledges that he received the request and will not appear for on-the-record testimony at any time nor cooperate with the investigation.
