The client moved her account from Edward Jones and opened a managed account. The liquidations of the prior holdings created taxable gains. The client did not include the 1099 from the account when filing her taxes and later received notice of additional taxes due. Client also alleges misrepresentation during sale of annuity products.

I firmly disagree with this person's allegations and I believe our comprehensive process and file notes prove it. From the moment she attended my two day, five hour retirement class, we worked with her for a total of over 34 hours, through 13 office and zoom meetings and 8 free client lunch events for education and updates on all aspects of her portfolio allocations and investments. The client was presented with a comprehensive retirement plan based on her goals and risk tolerance which included the reallocation of her non-qualified brokerage account, which was all individually owned stocks, into a more balanced platform which was in line with her investment objectives and risk tolerance. She was informed about capital gains taxes on non-IRA reallocations. She decided to reallocate but failed to include the 1099 that was sent to her on her self-prepared tax return. Because of this error, she incurred penalties. Up until that moment, for a period of over 2 years, she was very happy with our relationship and her Investment results. One note from the client meetings reads, "Happy with investments. Glad she moved them when she did." All of my files and notes have been reviewed by my regulating authority and my actions and plan were in accordance with her risk tolerance and financial objectives. They deemed that there was no failure on my part which caused any such loss as claimed.We spent more time with her than most any other single client during the same period of time. We discussed all aspects of her life in order to help prepare her for her retirement including her investments, health, and business transition. This client also referred one of her friends to our firm because she was enjoying her client experience.

THROUGHOUT THE YEAR 2002, THE SUPERVISOR AND REGISTERED PRINCIPAL OF THE METLIFE OFFICE WAS MADE AWARE OF AND APPROVED OF OUR OUTSIDE BUSINESS ACTIVITIES. I HAVE NEVER BEEN SECURITIES LICENSED WITH ANOTHER BROKER-DEALER. METLIFE'S STATEMENT IS FALSE AND IS BEING DISPUTED.
