Time Frame: July 22, 2016 to July 10, 2018 The client's attorney alleges the Financial Advisor made representations that the policy value would be paid to the estate in the event she predeceased her husband. The attorney further alleges the Financial Advisor failed to follow procedures he discussed with the client's that was necessary to insure the estate and her children would receive the policy value when the client passed away. The alleged damages are estimated to be in excess of $5,000.00.

I deny the allegations and believe them to be without merit or fact. I was not the broker of record at the time the investment in question was purchased. I did not recommend or solicit the client to purchase the product. The crux of the matter is a disagreement between beneficiaries and who the inheritor of an annuity payout would be. Again, this was not a product that was solicited by me and the drop in value is a result of the extreme market volatility. This matter was settled for business reasons to avoid the cost And uncertainties of the litigation forum.

TIME FRAME: JANUARY THRU OCTOBER 13, 2008 CLIENT VERBALLY ALLEGES THAT SHE AND THE FA DISCUSSED MOVING SUB-ACCOUNTS IN THE ANNUITY FROM A MIXTURE OF ADVISORS FUND AND FIXED TO A TOTAL FIXED ACCOUNT HOWEVER, THE FA DID NOT MAKE THE SWITCH IN THE ACCOUNTS ON THE DATES DISCUSSED.
