SEC IA Release 4979, August 9, 2018: The Securities and Exchange Commission (Commission) deems it appropriate and in the public interest that public administrative proceedings be, and hereby are, instituted pursuant to Section 203(f) of the Investment Advisers Act of 1940 (Advisers Act) against Melvin Leonard "Lee" Wimmer, Jr. (Wimmer). On the basis of this Order and Wimmer's Offer, the Commission finds that on May 21, 2018, Wimmer pled guilty to one count of securities fraud in violation of Title 18, United States Code, Section 1348 before the United States District Court for the District of South Carolina, in United States of America v. Melvin Lee Wimmer, Jr., No. 8:18-cr-296. The count of the criminal information to which Wimmer pled guilty alleged, inter alia, that, from 2010 to 2017, Wimmer knowingly and willfully devised a scheme and artifice to defraud and to obtain money and property by means of false and fraudulent pretenses, representations, and promises in connection with the purchase and sale of a security of an issuer with a class of securities registered under Section 12 of the Securities Exchange Act of 1934.
